These Terms and Conditions ("Terms") govern your access to and use of the services provided by Трогни.ме Ltd through our website at trogni.me. By using our Service, you agree to be bound by these Terms.

1. Definitions

• "User," "you," "your" — any individual who accesses or uses the Service
• "AI-Generated Song" — personalised audio content created using AI based on information you provide
• "Preview" — the free 30-second audio excerpt available before purchase
• "Service" — the website and song generation service at trogni.me

By using the Service you confirm you are at least 18 years old and have the legal capacity to enter into binding contracts.

3. How the Service Works

Трогни.ме operates on a free preview model:

1. You complete our form with details about the recipient and occasion
2. Our AI generates your personalised song (typically 3–5 minutes)
3. You receive a free 30-second preview — no registration or payment required
4. You pay only if you like the preview
5. Upon payment, you receive the full song instantly

We generate two versions (Version A and Version B) for you to choose from before purchasing.

4. Plans and Pricing

All prices are one-time payments with no subscription. Prices are in Euros and may include applicable taxes depending on your location.

5. Payment

Payments are processed securely by Stripe. We do not store your payment card details. By purchasing you agree to Stripe's Terms of Service.

6. Refund Policy

Before download: Full refund available within 24 hours if you have not downloaded the song. Contact hello@trogni.me.

After download: Due to the personalised digital nature of the product, refunds are generally not provided after download except in cases of:

• Technical failure preventing delivery
• Significantly poor quality that re-generation cannot resolve

Important: Our free preview model means you can hear 30 seconds before paying. By purchasing after hearing the preview, you accept the song as meeting your basic expectations.

Premium revision: Premium plan users are entitled to 1 free revision within 7 days of delivery.

7. Intellectual Property

Upon purchase, you are granted a limited, non-exclusive, non-transferable licence to use the purchased song for personal, non-commercial purposes including sharing on personal social media and use at personal events.

• You may not use the song for commercial purposes without a separate written licence
• You may not resell or sublicense the song
• You may not modify and redistribute the song as your own work

8. User Responsibilities

You are responsible for the content you provide and must ensure it does not infringe third-party rights. You agree not to request songs containing offensive, hateful, racist, discriminatory, or defamatory content.

9. AI Limitations

The AI technology used to generate songs is inherently unpredictable. We do not guarantee specific content, style, or quality beyond what is demonstrated in the preview. By purchasing, you acknowledge this unpredictability.

10. Limitation of Liability

The Service is provided "as is." Our total liability for any claim shall not exceed the amount paid by you for the specific order. We are not liable for indirect, incidental, or consequential damages.

11. Force Majeure

We are not liable for failure to perform due to events beyond our reasonable control including failures of third-party AI providers (Anthropic, Suno, ElevenLabs).

12. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be submitted to the courts of England and Wales. Nothing in these Terms affects your statutory rights as a consumer under UK law including the Consumer Rights Act 2015.

13. Changes to Terms

We may update these Terms at any time. Changes become effective upon posting. Your continued use of the Service signifies acceptance.
